Sqarim praktik ministres së Arsimit Vesna Janevska dhe ministrit të Drejtësisë Jeton Shasivari në gjuhën shqipe
Kushtetuta e RMV-së e garanton shprehimisht të drejtën e pjesëtarëve të komuniteteve për mësim në gjuhën e tyre në arsimin fillor dhe të mesëm.
Neni kryesor: Neni 48 – paragrafi 4
Pas Amendamentit VIII të vitit 2001, formulimi kushtetues është:
“Pjesëtarët e komuniteteve kanë të drejtë në mësim në gjuhën e tyre në arsimin fillor dhe të mesëm, në mënyrën e përcaktuar me ligj.”
Po në këtë dispozitë thuhet se në shkollat ku mësimi zhvillohet në një gjuhë tjetër, mësohet edhe gjuha maqedonase.
Pra, për çështjen që po ngacmon Ministresha e MASH-it Janevska (më sakt në Idrizovë-Shkup):
- Neni 44 → garanton të drejtën e arsimit për të gjithë dhe përcakton se arsimi fillor është i detyrueshëm dhe falas.
- Neni 48, paragrafi 4 / Amendamenti VIII → garanton mësimin në gjuhën e komunitetit në arsimin fillor dhe të mesëm.
- Kjo e drejtë kushtetuese nuk kushtëzohet nga përqindja e komunitetit në komunë. Edhe Gjykata Kushtetuese ka theksuar se e drejta për arsim në gjuhën e komunitetit nuk lidhet me çështjen e përdorimit të gjuhës në një komunë.
Kjo është shumë e rëndësishme nëse e lidhim me deklaratat e ministres së Arsimit për shkollat/nxënësit shqiptarë.

Practical clarification for Minister Vesna Janevska and Minister of Justice Jeton Shasivari:
The Constitution of the Republic of North Macedonia is very clear on this issue. Amendment VIII, which replaced Article 48 of the Constitution, explicitly guarantees members of communities the right to instruction in their own language in primary and secondary education, as determined by law. In practical terms, this means that education in the Albanian language is not simply a political decision or a privilege granted by the Ministry of Education. It is a constitutionally guaranteed right.
Article 44 additionally establishes that everyone has the right to education and that primary education is compulsory and free. The Constitutional Court has specifically stated that the right of communities to education in their own language is a basic cultural right guaranteed by the Constitution, and that the State has an obligation to take appropriate measures to implement it. Therefore, the practical question for the Minister of Education is not:
“Should education in Albanian be provided?”
but rather:
“How will the State ensure the effective implementation of the constitutionally guaranteed right to education in Albanian?”
And for the Minister of JusticeJeton Shasivari.
“Can a ministry, regulation or administrative decision restrict a right that is expressly guaranteed by the Constitution?”
The Constitution itself provides the hierarchy: laws and other regulations must be in accordance with the Constitution. The Constitutional Court has also emphasized this principle in connection with Article 48. (Constitutional Court of North Macedonia)
In one sentence:
The Constitution guarantees the right; the law regulates how that right is implemented; the administration cannot simply abolish or arbitrarily restrict the constitutional right.

Практично појаснување за министерката за образование Весна Јаневска и министерот за правда Јетон Шашивари на македонски јазик
Член 48 став 4 од Уставот на Република Северна Македонија:
„Припадниците на заедниците имаат право на настава на својот јазик во основното и средното образование на начин утврден со закон. Во училиштата во кои образованието се одвива на друг јазик се изучува и македонскиот јазик.“
Оваа одредба е дел од Амандманот VIII, со кој беше заменет членот 48 по 2001 година.
